General Terms and Conditions
1. Introductory Provisions
These Terms and Conditions (together with the Podia Privacy Policy available on the Podia Privacy Policy and, where applicable, the Podia Data Processing Addendum for the EU available on the Podia DPA) govern the relationship between Paulus Yoga Ltd, with registered office at K hájovně 129/36, 14200 Prague, ID: 07864833 (hereinafter referred to as “Provider”), and a user who purchases access to online courses, memberships, lesson packages or books participation in live events such as workshops, retreats, etc. (hereinafter referred to as “User”).
2. Agreement to the Terms and Conditions
By registering for or using the services (the “Services”) in any way, including simply browsing the site, the User agrees to these Terms, the Privacy Policy, and the EU Data Processing Addendum, if applicable. The Provider reserves the right to update these Terms without notice.
3. Content and access to courses and services
3.1 Products include digital courses, cohort courses, lesson packages, monthly memberships and live events (e.g. workshops, retreats).
3.2 Digital Products are available on the platform where they were purchased for a period of 2 years from the date of purchase, unless otherwise stated.
3.3 Purchased content is for the User's personal use only and may not be downloaded, copied, shared or otherwise distributed in any way without the Provider's prior written permission.
4. Payment terms
4.1 The price of the Courses and Services is inclusive of all fees and taxes.
4.2 The User may choose between a lump sum payment and payment in instalments if this option is available. In the case of an instalment plan option, the User undertakes to pay the full amount of the Product.
4.3 In the event of non-payment of instalments, Users' access to the Products may be restricted or cancelled.
5. Cancellation Policy
5.1 For digital products and monthly memberships, no refunds can be requested once access to the content has commenced.
5.2 For live events (workshops, retreats, etc.), the User is entitled to cancel his/her reservation no later than 2 weeks before the start of the event without a refund. If the booking is cancelled less than 2 weeks before the event date, a 100% cancellation fee applies.
6. Content security and prohibition of unauthorised downloading
6.1 The User may not download, copy, distribute or otherwise tamper with the content of the Courses and Products in any way.
6.2 Violation of this provision may result in immediate denial of access and legal action by the Provider.
7. Provider's rights and obligations
7.1 The Provider has the right to deny access to Users who violate these Terms.
7.2 The Provider undertakes to maintain the availability of digital products on the Platform for a period of 2 years from the date of purchase, unless unexpected technical or other serious circumstances arise.
8. Rules of conduct of the User
8.1 User agrees to use the Services in accordance with these Terms and not to use them for illegal or unethical purposes, including the distribution of malicious software, copyright infringement or other unauthorized use of content.
8.2 User shall not copy, distribute or modify the Content without the express permission of Provider. Any unauthorized distribution of the Content may be considered copyright infringement.
9. Limitation of liability
9.1 The Provider shall not be liable for technical problems, outages or loss of data that may temporarily limit access to the content of the Services. The Provider endeavours to ensure the availability of the Services but is not responsible for any outages caused by technical or system failures.
9.2 All Content and Services are provided “as is” without any guarantee of results or effectiveness for the User.
10. Disclaimer of Warranties
10.1 Provider does not guarantee the results User expects from the use of the Services and shall not be liable for unsatisfactory results. The Services are provided without warranty of any particular functionality or achievement of any particular result.
10.2 The User uses the Content and Services at his/her own risk and the Provider shall not be liable for any direct or indirect damages caused by the use of the Services.
11. Dispute resolution
11.1 All disputes arising in connection with the use of the Services shall be resolved in accordance with the laws of the Czech Republic. The User and the Provider undertake to resolve disputes amicably.
11.2 If an amicable solution cannot be reached, the dispute shall be resolved before the competent courts of the Czech Republic.
12. Modification of the Terms and Conditions
12.1 The Provider reserves the right to modify these Terms at any time. The User will be informed of the changes via the website or by e-mail. Continued use of the Services after the modification of the Terms implies acceptance of the updated Terms.
13. Privacy Policy
The Provider shall process the User's personal data in accordance with the applicable legislation and privacy policy.
14. Final provisions
14.1 These Terms are governed by the applicable laws of the Czech Republic.
14.2 The Provider reserves the right to modify these Terms at any time. The User will be informed of the changes via the website.
